1. Acceptance of Terms

By accessing or using SendTrip ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of modified Terms.

2. Description of Service

SendTrip is an AI-powered trip planning platform specializing in action sports destinations (kitesurfing, windsurfing, wing foiling, skiing). We provide:

• AI-powered destination recommendations based on weather data, skill level, and preferences
• Historical weather data and forecasts for 250+ destinations worldwide
• Integration with third-party booking services (flights, accommodation)
• Trip planning tools and itinerary management
• Community features and content (future functionality)

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account using Google, Facebook, or email/password authentication. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of unauthorized access

3.2 Age Requirement

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Conduct

You agree NOT to:

• Use the Service for illegal purposes or violate any laws
• Impersonate another person or entity
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or automatically extract data from the Service
• Interfere with or disrupt the Service or servers
• Use the Service to spam, harass, or abuse others
• Reverse engineer, decompile, or disassemble any part of the Service
• Abuse AI features through excessive requests or manipulation

5. AI-Generated Recommendations

5.1 No Guarantee of Accuracy

Our AI-powered recommendations are based on historical weather data, user preferences, and algorithms. While we strive for accuracy, we do NOT guarantee:

• Perfect accuracy of weather predictions or recommendations
• Suitability of destinations for your specific skill level or needs
• Safety or conditions at recommended destinations
• Availability of services, schools, or infrastructure mentioned

5.2 User Responsibility

YOU are responsible for:

• Verifying all information before making travel decisions
• Assessing your own skill level and safety requirements
• Checking current weather conditions and forecasts before traveling
• Following local laws, regulations, and safety guidelines
• Obtaining appropriate insurance and equipment

6. Third-Party Services and Affiliate Links

6.1 Affiliate Disclosure

SendTrip participates in affiliate programs with Booking.com, Kiwi.com, GetYourGuide, and other travel partners. When you click affiliate links and make purchases, we may earn a commission at no additional cost to you.

6.2 Third-Party Responsibility

We are NOT responsible for:

• Services provided by third-party booking platforms
• Accuracy of prices, availability, or descriptions on third-party sites
• Quality of accommodations, flights, or activities booked through partners
• Disputes with third-party service providers
• Terms and conditions of third-party services

Your transactions with third parties are governed by their respective terms and conditions. We act only as a referral service.

7. Intellectual Property

7.1 Our Content

All content on SendTrip, including text, graphics, logos, software, algorithms, and design, is owned by SendTrip or licensed to us. You may NOT:

• Copy, reproduce, or distribute our content without permission
• Use our trademarks, logos, or branding
• Create derivative works based on our Service
• Use our data for commercial purposes

7.2 User Content

By submitting content (reviews, comments, photos), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

8. Disclaimers and Limitation of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, SENDTRIP SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or goodwill
• Service interruptions, errors, or data loss
• Inaccurate weather data or predictions
• Actions of third-party service providers

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Breach of any consumer protection rights that cannot be excluded by law
• Any other liability that cannot be excluded under applicable law

8.3 Limitation Amount

Subject to Section 8.2, our total liability to you for any claims arising from use of our free service shall not exceed €100.

This limitation does not apply to liability that cannot be excluded or limited by law, including liability for fraud, gross negligence, or personal injury.

9. Indemnification

You agree to indemnify and hold harmless SendTrip, its affiliates, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Your conduct at destinations recommended by the Service

10. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your data.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by the laws of Poland, without regard to conflict of law principles.

11.2 Dispute Process

Before filing a lawsuit, you agree to attempt to resolve disputes informally by contacting us at contact@sendtrip.app. We will attempt to resolve disputes within 30 days.

11.3 Jurisdiction

For Business Users: Any legal action must be filed in the courts of Wrocław, Poland.

For EU Consumers: In accordance with EU law, EU consumers may bring legal proceedings in either:

• The courts of Poland, OR
• The courts of the EU country where they habitually reside

This does not affect your statutory rights as a consumer under mandatory consumer protection laws.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service. Continued use after changes constitutes acceptance of modified Terms. If you do not agree to changes, you must stop using the Service.

13. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data after 30 days
• Sections regarding liability, indemnification, and disputes survive termination

14. Miscellaneous

14.1 Severability

If any provision of these Terms is found invalid, the remaining provisions continue in full force.

14.2 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

14.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SendTrip.

15. EU Consumer Rights

If you are a consumer in the European Union:

• You have the right to withdraw from certain contracts within 14 days under EU Directive 2011/83/EU
• Unfair contract terms are not binding on you under EU Directive 93/13/EEC
• You can access the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr
• These Terms do not affect your statutory consumer rights under EU law
• Nothing in these Terms limits your rights under mandatory consumer protection laws
